Terms of website use
These terms of use set out the terms on which you and the children in your care can use the Read with Phonics service via our App and Website. Please read these terms of use carefully. By using the Read with Phonics service you confirm that you accept these terms.
If you do not agree to these terms, you must not use the Read with Phonics service.
These terms also refer to our Privacy Policy, which explains how we use any personal information we collect from you, or which users of the Read with Phonics service provide to us.
For parents and legal guardians
By using the Read with Phonics service you consent to us using your data, as well as the data of the children you register to use the Read with Phonics service, as set out in our Privacy Policy. You may only register with the Read with Phonics service the children you have parental responsibility for.
There is a fee for parents and legal guardians for using the Read with Phonics service. The fees are charged as follows;
Stages 1, 2 and 3 - £2.99 each.
Stage 4 - £3.99.
All-inclusive price for Stages 1 to 4 - £7.99
This fee can be paid through any of the following methods, Google Play Store, Amazon App Store, App Store or online through our secure Stripe payment method. On receipt of payment we will provide access to our Read with Phonics service. Please note that we may change these fees at any time.
For teachers
By using the Read with Phonics service you consent to us using your data, as set out in our Privacy Policy.
By registering children to use the Read with Phonics service, you confirm that you have obtained consent (from the children's parents or legal guardians) for each child being registered:
- to use the Read with Phonics service; and
- for us to use their data as set out in our Privacy Policy.
Using the Read with Phonics service
The use of the Read with Phonics service by a child is subject to the consent of their parent or legal guardian, as set out in more detail in our Privacy Policy.
The Read with Phonics service is provided for general information only, and as a learning aid. It is not intended to be, and should not be used as, a substitute for any aspect of the national curriculum or a child's education.
Access to the Read with Phonics service is provided free of charge and on a temporary basis. We reserve the right to withdraw or change the Read with Phonics service without notice, and we cannot guarantee that the Read with Phonics service, including our App or Website, will be always available, or free from viruses, errors or omissions.
We may need to suspend or terminate access to the Read with Phonics service without notice where we suffer a system failure, or need to carry out maintenance or repair. We will not be liable to you or to any other person where all or any part of the Read with Phonics service is discontinued, modified or changed in any way.
You are responsible for making all arrangements necessary for you to access and use the Read with Phonics service, as well as making sure that everyone who accesses the Read with Phonics service through your internet connection are aware of these terms and our Privacy Policy, and that they comply with them.
Your account and password
You may be required to register your details or open an account to access some elements of the Read with Phonics service. If you decide to register, you undertake to complete the registration forms fully, and that all information you provide is up-to-date, true, accurate and complete.
Each registration is for a single account only, and the login details you choose when registering with the Read with Phonics service must be kept secure.
We have the right to suspend or disable your account at any time if we know or suspect that anyone other than you knows your login details, or if we believe that you have not complied with these terms of use or our Privacy Policy.
Prohibited uses
You may not use the Read with Phonics service:
in any way that breaches any applicable local, national or international law or regulation;
to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; or
if you do not have the necessary consents from a child's parents or legal guardians.
We work hard to provide you with an accessible and enjoyable service. Because of this, when using the Read with Phonics service you are prohibited from:
reproducing, copying or re-selling any part of the Read with Phonics service (though this does not restrict your ability to use any of our "sharing" functions, such as liking and sharing our Website on Facebook in accordance with that third party's terms and conditions); and
accessing, interfering with, damaging or disrupting any part of the Read with Phonics service, including any equipment or software used to provide the Read with Phonics service.
Intellectual Property Rights
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. All of these rights are reserved.
Any aspect of the Read with Phonics Service may not be copied, reproduced, communicated or made available to the public, (except for your own personal, private and non-commercial use) unless expressly permitted by us. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and our status (and that of any identified contributors) as the authors of the material made available via the Read with Phonics service must always be acknowledged.

Limitation of our liability
We cannot exclude or limit our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation. Nothing in these terms of use seeks to limit our liability for this, or any other liability that cannot be excluded or limited by English law.
If we fail to comply with these terms of use, we shall only be liable to you for losses that you suffer because of our failure which are a foreseeable consequence of our failure. We will not be liable for the following losses, whether direct or indirect, that result from our failure to comply with these terms of use: loss of income, revenue, business, profits, anticipated savings, data, or waste of management or office time. However, this will not prevent claims for loss of or damage to your tangible property that are foreseeable, or any other claims for direct loss that are not excluded.
Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Read with Phonics service or to your downloading of any content on it, or on any website linked to it.
Linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. If you wish to make any use of content on our site other than that set out above, please email us at support@readwithphonics.com.
Applicable law
These terms are governed by English law and you can bring legal proceedings in respect of the Read with Phonics service in the English courts. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or English courts.
Removal of personal data
If you are no longer using Read with Phonics and wish for us to remove your data, please email sophie@readwithphonics.com
Changes to these terms
We may revise these terms of use at any time by amending this page. Please check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by notices published elsewhere on the Read with Phonics Website or App.
